Resumo: Há três dilemas vivenciados no Estado Democrático de Direito, a eleição entre o modelo procedimentalista ou substancialista, identificação de fontes da legitimidade da jurisdição constitucional e, por derradeiro, a defesa ou repúdio do ativismo judicial, principalmente, atinente aos direitos fundamentais.
